Last updated: November 2026 · Initial terms of use in effect since March 2017

1. Purpose

POOOL, a French simplified joint-stock company registered with the Bordeaux Trade and Companies Register under number 819 554 890, with a share capital of €104,626, whose registered office is located at 2 Rue Marc Sangnier, 33130 Bègles, France, operates a website available at https://poool.fr (the “Company”). These general terms of use (the “Terms of Use”) apply between the Company and any person who may access the Site (the “User”). Their purpose is to set out the rights and obligations of users of the website https://poool.fr and its related sites, such as https://poool.dev, operated via the main domain name https://poool.fr (the “Site”).

On each visit to the Site, the User undertakes to comply with these Terms of Use, which apply to the entire Site. Accordingly, the User accepts these Terms of Use in full and without reservation before any use of the Site. Merely accessing the Site automatically entails the User’s unreserved acceptance of these Terms of Use.

The Company reserves the right to modify these Terms of Use at any time without prior notice. Changes take effect as soon as they are published online. Users are therefore advised to refer regularly to the latest version of the Terms of Use, available at https://poool.fr/conditions. Continuing to use the services offered on the Site after the Terms of Use have been modified constitutes acceptance of the modifications.

2. Access to and use of the Site

2.1. Access to the Site is free of charge and viewing it does not require prior registration. Notwithstanding the foregoing, access to certain features, including in particular requesting a demo of the Company’s products on the Site, may require Users to provide personal information. In that case, Article 7 of these Terms of Use applies. The equipment and hardware used to access the Site, their updates, proper functioning and maintenance are the sole responsibility of the User, who also bears the telecommunication costs incurred to access and browse the Site (in particular the internet service provider’s fees).

2.2. The Company grants the User a right to consult and access the information available on the Site. In this respect, the User undertakes in particular to:

  • check that the computer configuration used contains no virus and is in perfect working order;
  • not copy all or part of the Site onto another website or any other medium;
  • not set up systems likely or designed to hack all or part of the Site, or to breach these Terms of Use;
  • inform the Company as soon as they become aware of any “hacking”, and in particular of any unlawful or non-contractual use of the elements on the Site, whatever the means of distribution used.

2.3. The User unconditionally accepts that browsing and using the Site is at their sole responsibility.

3. Availability of the Site

3.1. The Company undertakes to use its best efforts to secure access to, consultation and use of the Site. The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Company’s control, and in any event subject to possible outages, malfunctions and corrective or evolutionary maintenance necessary for the proper functioning and development of the Site. Maintenance may be carried out without prior notice to Users.

3.2. The Company reserves the right to modify, at its discretion and unilaterally, at any time and without prior notice, the configuration of the Site, as well as the right to delete, limit or suspend it or prohibit access to it, temporarily or permanently. Its liability cannot be engaged in this respect under any circumstances. The Company reserves the right to delete or modify any information on the Site, in particular information that contravenes national laws.

3.3. The User declares that they accept the characteristics and limits of the Internet, and in particular acknowledges that:

  • their use of the Site is at their own risk;
  • the Site is made available to them “as is” and subject to its availability;
  • protecting their own data and/or software is their responsibility, and it is up to them to take all appropriate measures to protect them from any viruses circulating on the Site.

4. Limitation of liability

4.1. Under no circumstances shall the Company be held liable for any direct or indirect damage resulting from the use of the Site or from the inability to access or use the services of the Site. The Company gives Users no guarantee as to the quality or availability of the Site, in particular in the event of interrupted connections, server failures, difficult or impossible internet connections, etc.

4.2. The Company cannot guarantee the reliability, completeness, accuracy or currency of the data on the Site, whether provided by the Company itself or by its partners. Accordingly, all data on the Site is provided for information purposes only. The Company cannot be held liable for any incomplete or inaccurate information.

4.3. The Company cannot be held liable for the presence of viruses on the Site.

4.4. The Company cannot be held liable for any incompatibility, malfunction or other technical problem between the use of the Site and the User’s computer equipment.

4.5. The User of the Site is liable for any damage caused by their connection to or use of the Site, whether to themselves, to third parties or to their equipment.

5. Prohibited conduct

The User may not send to or from the Site any pornographic, obscene, defamatory, abusive, threatening or harassing content, content infringing privacy or image rights, illegal content or any other content that may constitute a criminal offence or engage the civil liability of the Company.

6. Intellectual property

6.1. Without this list being exhaustive, the “POOOL” trademarks and their derivatives, the logos, the graphic charter, the layout, the information, the presentation and the content of the Site (videos, images, etc.) are the exclusive property of the Company, or the Company holds the rights and authorisations necessary to use them. The Company owns or holds the intellectual property rights to both the structure and the content of the Site, unless expressly stated otherwise.

6.2. Any reproduction or representation, in whole or in part, of the Site or of its components, such as the trademarks, logos, graphic charter, layout, information, presentation and content of the Site, without this list being limitative, is prohibited.

6.3. These Terms of Use do not transfer any intellectual property right to the User over either the structure or the content of the Site. The Company grants the User only a right to consult the Site, for strictly personal and private use, which the User expressly acknowledges and accepts.

6.4. The User expressly undertakes that their use of the Site shall in no way infringe the rights of the Company, and in particular that such use shall not constitute counterfeiting or unfair or parasitic competition.

7. Personal data

7.1. Users may freely browse the home page of the Site and the other pages that do not require registration or personal data. To benefit from the services offered by the Company, Users must subscribe to the Company’s services by contacting the Company directly at hello@poool.fr and signing a contract with the Company. The personal information required for this subscription is mandatory. A valid email address is required. This data is collected by the Company to manage its relationship with the Users of the Site.

In addition, to use certain services or features offered free of charge by the Company on the Site, such as newsletters and the contact and demo request forms, without this list being exhaustive, Users must provide certain mandatory personal information (in particular email address, first and last name).

In accordance with the General Data Protection Regulation (EU) 2016/679 and the French Data Protection Act of 6 January 1978 as amended, each User has a right of access, modification, rectification, portability and erasure of the data concerning them. More information is available in our Privacy policy.

Users may exercise their rights by email at data@poool.fr or by post at: POOOL – 2 Rue Marc Sangnier, 33130 Bègles, France.

7.2. POOOL may collect personal data indirectly through cookies, as described in our Cookie policy. The Site may use cookies in particular to facilitate access to its services, ensure they operate and analyse them.

8. Miscellaneous

8.1. If any provision of these Terms of Use is declared null or unenforceable by virtue of a law, regulation or final court decision, it shall be deemed unwritten and the other provisions shall remain in force.

8.2. The contractual relationship between the Company and the User is governed solely by these Terms of Use.

8.3. If the User fails to comply with any provision of these Terms of Use, the Company reserves the right to suspend the User’s access to the Site and to take any action against them.

9. Governing law and disputes
